Understanding DNA Database (Florida) in Florida
In Florida, the state's DNA Database is a critical law enforcement tool established under Section 943.325 of the Florida Statutes. Managed by the Florida Department of Law Enforcement (FDLE), this database contains genetic profiles collected from individuals arrested or convicted of felony offenses, as well as certain other specified crimes. Upon arrest for any qualifying offense, law enforcement officers collect a DNA sample, typically using a non-invasive buccal (cheek) swab. This sample is then processed and uploaded into the Combined DNA Index System (CODIS), a national network that allows local, state, and federal laboratories to compare and share DNA profiles.
The primary purpose of the Florida DNA Database is to aid in criminal investigations by linking suspects to unsolved crimes, identifying missing persons, and exonerating the wrongfully convicted. Once a profile is entered into CODIS, it is continuously run against DNA evidence collected from unsolved crime scenes. Under Florida law, the collection of this genetic material is mandatory at the booking stage of a felony arrest, meaning an individual cannot refuse the swab without facing additional legal consequences, regardless of whether they are ultimately convicted of the crime.
How the DNA Database Impacts Bail and Pretrial Release
Under Florida law, the mandatory DNA collection process must be completed during booking before a defendant can be cleared for pretrial release or bail. If an arrestee refuses to submit to the buccal swab, jail administrators will hold them in custody, delaying their release even if they have already secured a bail bond. Furthermore, if the database returns an immediate match ("cold hit") linking the defendant to an open warrant or an unsolved felony, the court may revoke any pre-set bail, increase the bond amount significantly, or order the defendant held without bond during their first appearance hearing.
