How Deferral Works
- Defendant enters a plea (guilty or nolo contendere)
- Judge defers sentencing and places defendant on probation
- Defendant completes probation conditions (community service, treatment, restitution)
- Upon successful completion, the judge may withhold adjudication
Deferred Sentence vs. Adjudication Withheld
These are related but different. Deferred sentencing delays the sentencing decision. Adjudication withheld is a sentencing outcome where the judge finds guilt but does not formally convict. A deferred sentence can result in adjudication withheld.
