Category: Sentencing · Statute: F.S. 948.01 · Source: Florida Legislature

How Deferral Works

  1. Defendant enters a plea (guilty or nolo contendere)
  2. Judge defers sentencing and places defendant on probation
  3. Defendant completes probation conditions (community service, treatment, restitution)
  4. Upon successful completion, the judge may withhold adjudication

Deferred Sentence vs. Adjudication Withheld

These are related but different. Deferred sentencing delays the sentencing decision. Adjudication withheld is a sentencing outcome where the judge finds guilt but does not formally convict. A deferred sentence can result in adjudication withheld.
