In Florida, trafficking in MDMA (commonly known as Ecstasy or Molly) is a first-degree felony governed by Section 893.135 of the Florida Statutes. Unlike the common understanding of "trafficking," which implies selling or transporting drugs across borders, Florida law defines trafficking solely by the weight of the substance involved. Anyone who knowingly sells, purchases, manufactures, delivers, brings into the state, or is in actual or constructive possession of 10 grams or more of MDMA can be charged with trafficking. Because MDMA is frequently distributed in pill, capsule, or powder form, law enforcement determines the weight based on the entire mixture or compound containing the drug, not just the pure active chemical.
This offense carries exceptionally harsh penalties due to legislatively mandated minimum mandatory prison sentences. If the weight of the MDMA mixture is between 10 and 199 grams, the court must impose a minimum of 3 years in prison and a $50,000 fine. For weights between 200 and 399 grams, the mandatory minimum rises to 7 years and a $100,000 fine. If the amount reaches 400 grams or more, the defendant faces a mandatory minimum of 15 years in state prison and a $250,000 fine. These mandatory minimums strip judges of their sentencing discretion, meaning a defendant convicted of these quantities must serve the specified time day-for-day without the possibility of early release or parole.
