Category: Criminal Offenses · Statute: F.S. 777.04 · Source: Florida Legislature

Elements of Solicitation

  1. The defendant requested, commanded, or encouraged another person
  2. To commit a specific crime
  3. With the intent that the crime be committed

Key Distinction

Solicitation is complete as soon as the request is made — the target crime does not need to be committed or even attempted. Simply asking someone to commit a crime is enough for a solicitation charge.

Penalties & Bail

Sentenced one degree below the target offense. Solicitation to commit murder is a 1st degree felony PBL. Bail varies based on the target crime.
