Definition: A formal declaration by the prosecutor that they will not pursue charges further at this time. A nolle prosequi ends the current prosecution but does not prevent the state from refiling charges later (unlike a dismissal with prejudice).

Nolle Pros vs. Dismissal
- Nolle prosequi — Prosecution dropped; charges can be refiled within the statute of limitations
- Dismissal without prejudice — Similar to nolle pros; can be refiled
- Dismissal with prejudice — Charges are permanently dismissed; cannot be refiled
Effect on Bail
When charges are nolle prossed, the bail bond is exonerated. Cash bail is refunded. However, since charges can be refiled, the defendant should remain aware that they could face the same charges again.
