In Florida, under Florida Statute Section 874.04, a "gang enhancement" is a sentencing penalty multiplier applied when a defendant commits a crime for the benefit of, at the direction of, or in association with a criminal street gang. Florida law does not criminalize mere membership in a gang, as doing so would violate constitutional protections regarding free association. Instead, the enhancement targets active participation in gang-related criminal conduct. To apply the enhancement, the state must prove a nexus between the underlying crime and the gang's activities, demonstrating that the offense was committed with the specific intent to promote, further, or assist in the gang's criminal enterprise.
When the prosecution successfully proves this connection, the underlying felony or misdemeanor is reclassified to the next higher degree.
