The Florida Arrest Process: Step by Step

Getting arrested is overwhelming. Here's exactly what happens in Florida, from the moment of arrest to release.

Step 1: Arrest & Transport

After arrest, you're transported to the county jail for booking. This typically takes 30-60 minutes depending on distance.

Step 2: Booking

At the jail, you'll be: fingerprinted, photographed (mugshot), searched, your personal property inventoried, and asked for medical/health information. Booking takes 2-4 hours.

Step 3: Bond Setting

For most misdemeanors and non-violent felonies, bond is set per the county's bond schedule — a pre-set list of bail amounts by charge. You may be able to post bond immediately after booking.

Step 4: First Appearance (Within 24 Hours)

Florida law requires you appear before a judge within 24 hours. At first appearance, the judge: reviews the charges, sets or modifies bond, appoints a public defender if needed, and advises you of your rights.

Step 5: Posting Bond

Once bond is set, a family member or friend calls a bail bondsman (like QuickBail at (941) 477-6888). The bondsman posts the bond (you pay 10% of the total). Release processing takes 4-8 hours at most Florida jails.

Step 6: Release

After the bond is posted and processed, you're released with a court date. You must appear at all scheduled court hearings.
