Juvenile Arrest in Florida
When a minor (under 18) is arrested in Florida, the process differs significantly from adult arrests.
Parents Must Be Notified
Law enforcement must immediately notify at least one parent or guardian of the arrest and where the juvenile is being held.
Detention Decision
The Department of Juvenile Justice (DJJ) — not the court — makes the initial detention decision using a risk assessment instrument (DRAI). Many juveniles are released to parents within hours.
Civil Citation Program
For first-time misdemeanor offenses, many Florida jurisdictions use civil citations instead of arrest. The juvenile completes community service and any required programs instead of going through the court system.
